What’s regulated is operating an exchange in Indonesia (which needs an OJK license and full ID-based KYC) and paying with crypto. As we read the current rules, a foreign non-custodial swap is best described as an unregulated activity rather than a licensed local service — what the law targets is the unlicensed operator and the payment use. A foreign non-custodial swap won’t withhold anything — which doesn’t mean the tax disappears. It means the reporting obligation lands on you, and the rate Indonesia intends for offshore activity is the higher 1%.
