As we read the current rules, a foreign non-custodial swap is best described as an <em>unregulated<\/em> activity rather than a licensed local service \u2014 what the law targets is the unlicensed operator and the payment use. We&#8217;re not aware of a rule that criminalizes an individual for self-custodying crypto or using such a swap, but you should verify current Indonesian regulations and tax obligations. (Service VAT \u2014 e.g. on miners \u2014 still applies.)<\/li>\n<\/ul>\n<p>Here&#8217;s the important nuance. On a domestic licensed exchange, that 0.21% is <strong>withheld at source<\/strong> by the platform. A foreign non-custodial swap <strong>won&#8217;t withhold anything<\/strong> \u2014 which doesn&#8217;t mean the tax disappears. It means the <strong>reporting obligation lands on you<\/strong>, and the rate Indonesia <em>intends<\/em> for offshore activity is the higher 1%.<\/p>\n<p>People still choose an offshore no-KYC swap for reasons the domestic venues can&#8217;t match \u2014 privacy at any amount, self-custody, and access to coins outside the OJK whitelist.
